Terms of use
A few ground rules for keeping and passing on recommendations.
About these terms
These terms describe use of the SendRecs website and related service, operated by Mala Studio Inc., a Delaware corporation with operations in California. The privacy policy explains information handling. The iOS app is licensed under Apple’s standard licensed application agreement. These terms govern the separate SendRecs website and services; they do not replace that app license or override its controlling provisions.
Accepting these terms
When we present these terms with an “Agree and continue” button or another control clearly labeled as acceptance, selecting that control means you agree to these terms. If you do not agree, do not select it or access features that require acceptance. The privacy policy explains our data practices; accepting these terms does not replace any separate permission required for processing your information.
Using SendRecs
SendRecs helps you keep recommendations, identify places, organize lists, and share snapshots. Use it lawfully and respect other people’s privacy and rights. Do not submit unlawful, threatening, harassing, or infringing content, distribute private information without permission, misuse the signup form, or interfere with the service.
The initial beta is available to residents of the United States who are at least 18 and have reached the age of majority where they live. You must be entitled to use the service under the rules that apply where you live.
Your words and shared lists
You retain your rights in content you submit. You give the operator permission to process, store, and display that content as needed to provide the features you use, including processing by service providers and hosting snapshots you choose to share. You are responsible for having the rights and permissions needed for your content.
Anyone with a shared-list link can read it and forward it. Published snapshots are separate from the private library; later edits or deletion in the app do not revoke existing links. Avoid sharing sensitive or confidential information. Contact support about a removal request or problematic content.
Place information
Matching and place details can be incomplete, incorrect, or out of date. Check the suggested place before keeping it, and verify opening hours, availability, accessibility, and other important details directly with the venue. A recommendation is someone’s opinion, not a guarantee.
Beta availability
Beta features may change, fail, or be withdrawn. Access may be limited, and joining the waitlist does not guarantee an invitation or a release date. Keep a separate copy of information you cannot afford to lose. TestFlight distribution is also subject to Apple’s applicable terms.
Service changes and misuse
The operator may change or discontinue features and restrict misuse to protect the service and its users. Report unlawful or harmful public content with its link and a brief explanation. The operator may remove content that violates these terms or applicable law.
Third-party services and recommendations
SendRecs is not a party to any transaction you make with a venue or other third party. We do not operate, inspect, or endorse venues merely because they appear in a list. Third-party services, including Apple, mapping services, and linked websites, have their own terms. You are responsible for deciding whether a recommendation is appropriate for you.
Warranty disclaimer
To the extent the law allows, SendRecs and its content are supplied as is and as available. Mala Studio Inc. disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, noninfringement, and accuracy. We do not warrant uninterrupted availability, successful matching, or freedom from errors, harmful code, or data loss. Statements by support do not create additional warranties. This disclaimer does not remove warranties or remedies that applicable law requires.
Limits on liability
To the fullest extent permitted by law, Mala Studio Inc. and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, goodwill, or data arising from these terms or the service, even if advised that such losses could occur.
To the fullest extent permitted by law, their combined total liability for claims arising from these terms or the service will not exceed the greater of US $100 or the amount you paid Mala Studio Inc. for the affected service during the 12 months before the event giving rise to the claim. This is an aggregate limit, not a separate limit for each claim, and applies regardless of the legal theory asserted.
These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or any liability or statutory remedy that cannot lawfully be excluded or limited. Where a limitation is not allowed, it applies only to the extent the law permits. Nothing here waives mandatory consumer protections.
Claims arising from your content or misuse
To the extent permitted by law, you agree to indemnify Mala Studio Inc. against third-party claims, resulting damages, and reasonable legal costs to the extent caused by content you knowingly submit without necessary rights, your unlawful use of the service, or your intentional material breach of these terms. This obligation does not cover losses caused by our misconduct or breach of law. We will promptly notify you of a claim, reasonably cooperate in its defense, and not agree to a settlement imposing an obligation on you without your consent.
Governing law and disputes
Delaware law governs these terms and disputes concerning the SendRecs service, except where applicable federal law or mandatory protections in your home state require otherwise. Subject to those protections, you and Mala Studio Inc. agree to bring such disputes in the state or federal courts located in Delaware and consent to their jurisdiction. Either party may bring an eligible claim in a small-claims court with jurisdiction. These terms do not require arbitration or waive rights that cannot legally be waived.
You may contact Contact support: support@sendrecs.app to try to resolve a concern informally. Contacting us is not a prerequisite to seeking legal relief and does not suspend legal deadlines.
Ending use and general terms
You may stop using SendRecs at any time. We may suspend or end access for material violations, security threats, or legal requirements. Stopping use or deleting the app does not remove previously published snapshots; request removal through support. Content permissions continue only as needed to operate retained shared snapshots, meet legal obligations, and complete deletion under the privacy policy.
If a provision is unenforceable, it will be limited or severed as necessary and the remaining provisions will continue to apply. A failure to enforce a provision is not a waiver. Provisions concerning accrued obligations, liability limits, disputes, and claims from misuse survive termination to the extent applicable.
Contact and updates
Contact support: support@sendrecs.app. Updated terms will carry an effective date. We will give notice of material changes and obtain renewed acceptance where required. Changes will not apply retroactively to an existing dispute without agreement.
